IMPORTANT MEDICAL DISCLAIMER<\/strong><\/h3>\n\n\n\n<p><strong>The App is an informational tool, not a medical device.<\/strong> The Services, including all medically-related information, are for informational purposes only. We do not warrant or guarantee any treatment, therapy, medication, device, diagnosis, action, or recommendation available through the Services.<\/p>\n\n\n\n<p><strong>THE APP IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.<\/strong> Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard or delay seeking professional medical advice because of something you have read on the App.<\/p>\n\n\n\n<p><strong>THE APP DOES NOT PRESCRIBE, DISPENSE, OR FACILITATE THE PURCHASE OF CONTROLLED SUBSTANCES OR PRESCRIPTION MEDICATIONS.<\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>2. Agreement to Terms<\/strong><\/h3>\n\n\n\n<p>This Terms of Service agreement (&#8220;Terms&#8221;) and our Privacy Policy describe the terms and conditions on which Glippy LLC (&#8220;we,&#8221; &#8220;us,&#8221; or &#8220;our&#8221;) offers you access to the Glippy mobile and web application (the &#8220;App&#8221; or &#8220;Services&#8221;).<\/p>\n\n\n\n<p>Before accessing and using the Services, please read these Terms carefully because they constitute a legal agreement between us and you.<\/p>\n\n\n\n<p><strong>BY ACCESSING AND USING THE SERVICES, YOU AFFIRM THAT:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>YOU HAVE READ AND UNDERSTAND THESE TERMS;<\/strong><\/li>\n\n\n\n<li><strong>YOU WILL COMPLY WITH THESE TERMS; AND<\/strong><\/li>\n\n\n\n<li><strong>YOU ARE AT LEAST THE AGE OF LEGAL MAJORITY IN YOUR PLACE OF RESIDENCE AND ARE OTHERWISE LEGALLY COMPETENT TO ENTER INTO CONTRACTS.<\/strong><\/li>\n<\/ul>\n\n\n\n<p>If you do not agree with all of these Terms, you are expressly prohibited from using the App and must discontinue use immediately.<\/p>\n\n\n\n<p>We reserve the right to make changes to these Terms at any time. We will alert you about any changes by updating the &#8220;Effective Date.&#8221; Your continued use of the App after such changes constitutes your acceptance of the new Terms.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>3. Privacy Policy<\/strong><\/h3>\n\n\n\n<p>Your privacy is important to us. Please review our <a href=\"https:\/\/glippy.app\/resources\/privacy-policy\/\" data-type=\"link\" data-id=\"https:\/\/glippy.app\/resources\/privacy-policy\/\"><strong>Privacy Policy<\/strong><\/a> to understand how we collect, use, and share information about you. By using the Services, you agree that we can use such data in accordance with our Privacy Policy.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>4. User Conduct and Content Policy<\/strong><\/h3>\n\n\n\n<p><strong>4.1. Eligibility<\/strong> You must be at least 18 years of age (or the age of legal majority in your place of residence) to create an account and use the Services. By creating an account, you represent and warrant that you meet this requirement.<\/p>\n\n\n\n<p><strong>4.2. Prohibited Conduct<\/strong> Your permission to use the Services is conditioned upon your agreement that you will not, and will not encourage or assist any other user to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Attempt to gain unauthorized access to the Services, user accounts, or our computer systems through hacking, password mining, or any other means.<\/li>\n\n\n\n<li>Use any robot, spider, scraper, or other automated means to access the Services for any purpose without our express written permission.<\/li>\n\n\n\n<li>Create more than one account by automated means or under false or fraudulent pretenses.<\/li>\n\n\n\n<li>Impersonate another person or otherwise misrepresenting your affiliation with a person or entity.<\/li>\n\n\n\n<li>Harass, abuse, stalking, threatening, or defrauding other users.<\/li>\n<\/ul>\n\n\n\n<p><strong>4.3. Objectionable Content Policy<\/strong> We maintain a zero-tolerance policy for objectionable content. You may not post, upload, or share any content (&#8220;User Content&#8221;) that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Is sexually explicit, pornographic, obscene, or contains nudity.<\/li>\n\n\n\n<li>Is violent, defamatory, libelous, threatening, or promotes violence or actions that are threatening to any person or entity.<\/li>\n\n\n\n<li>Promotes or incites hate speech, discrimination, or disparagement against individuals or groups based on race or ethnic origin, religion, disability, age, nationality, veteran status, sexual orientation, gender, gender identity, or any other characteristic that is associated with systemic discrimination or marginalization.<\/li>\n\n\n\n<li>Is unlawful or promotes any illegal activity.<\/li>\n\n\n\n<li>Constitutes the sale, trade, or distribution of prescription medications.<\/li>\n\n\n\n<li>Solicits or facilitates the purchase of medications from unregulated or unlicensed sources.<\/li>\n\n\n\n<li>Constitutes giving or soliciting medical advice.<\/li>\n\n\n\n<li>Infringes on any third party&#8217;s intellectual property rights, including copyright, trademark, or patent.<\/li>\n\n\n\n<li>Is fraudulent, false, misleading, or deceptive.<\/li>\n\n\n\n<li>Is otherwise objectionable in our sole judgment.<\/li>\n<\/ul>\n\n\n\n<p>Users found attempting to buy, sell, or trade GLP-1 medications or any other prescription drugs will be permanently banned from the Services immediately without warning.<\/p>\n\n\n\n<p><strong>4.4. Enforcement and Termination<\/strong> We have the right, but not the obligation, to monitor all User Content and user activity. In accordance with our zero-tolerance policy, we reserve the right to take any of the following actions at our sole discretion, at any time, and without prior notice to you:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Remove any User Content that violates these Terms.<\/li>\n\n\n\n<li>Suspend, disable, or permanently terminate your access to the Services.<\/li>\n<\/ul>\n\n\n\n<p>We are not responsible for any delay or failure to remove such content.<\/p>\n\n\n\n<p><strong>4.5. User Reporting<\/strong> You may report any user or content that you believe violates these guidelines by using the in-app reporting feature or by contacting us at support@glippy.app. We will review all reports and take appropriate action.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>5. User-Generated Content<\/strong><\/h3>\n\n\n\n<p>You retain your rights to any content you submit or post in the App (&#8220;User Content&#8221;). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, process, adapt, publish, transmit, and display such User Content in any and all media in connection with providing the Services. This license authorizes us to make your content available to the rest of the community and to let others do the same. You represent that you have all the necessary rights to grant us this license for any content you submit.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>6. App Updates<\/strong><\/h3>\n\n\n\n<p>We may, in our sole discretion, develop and provide updates for the App, which may include upgrades, bug fixes, or new features (&#8220;Updates&#8221;). Updates may also modify or delete certain features. You agree that we have no obligation to provide any Updates or to continue to provide or enable any particular features. You agree to promptly download and install all Updates, and you acknowledge that the App may not operate properly if you fail to do so.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>7. External Links<\/strong><\/h3>\n\n\n\n<p>The App may contain links to third-party websites and services (&#8220;Linked Services&#8221;). Linked Services are not under our control, and we are not responsible for them. We provide these links for your convenience only and do not endorse, investigate, or monitor them. You access Linked Services at your own risk.<\/p>\n\n\n\n<p>While we may provide links to third-party healthcare resources for your convenience, <strong>we do not endorse and are not responsible for the clinical services or medications provided by these third parties.<\/strong> You are encouraged to verify the credentials and licenses of any third-party provider.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>8. Subscriptions and Payments<\/strong><\/h3>\n\n\n\n<p>The App is currently free to use. In the future, we may offer optional premium features through a paid subscription. All payments will be processed through the third-party app store from which you downloaded the application (e.g., Apple App Store or Google Play Store). You may cancel any future subscriptions at any time through your respective app store account settings.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>9. Disclaimers and No Warranties<\/strong><\/h3>\n\n\n\n<p>THE SERVICES ARE PROVIDED \u201cAS IS\u201d AND \u201cAS AVAILABLE\u201d WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE SPECIFICALLY DISCLAIM ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR THAT THEIR OPERATION WILL BE UNINTERRUPTED OR ERROR-FREE.<\/p>\n\n\n\n<p>SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>10. Limitation of Liability<\/strong><\/h3>\n\n\n\n<p>YOUR USE OF THE SERVICES IS AT YOUR OWN RISK. IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES. OUR MAXIMUM LIABILITY FOR ANY TYPE OF DAMAGES SHALL BE LIMITED TO THE LESSER OF THE TOTAL FEES PAID BY YOU TO US DURING THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY OR $1,000.<\/p>\n\n\n\n<p><strong>IF YOU ARE A CALIFORNIA RESIDENT, YOU WAIVE YOUR RIGHTS WITH RESPECT TO CALIFORNIA CIVIL CODE SECTION 1542,<\/strong> WHICH SAYS \u201cA GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH, IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR.\u201d<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>11. Indemnification<\/strong><\/h3>\n\n\n\n<p>You agree to defend and indemnify us and our affiliates from any liability, costs, and expenses (including attorneys\u2019 fees) arising from your violation of these Terms or your use of the Services.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>12. App Store Terms (Apple)<\/strong><\/h3>\n\n\n\n<p>This provision applies to the version of the App used on Apple, Inc. devices. This agreement is between you and us, not Apple. Apple has no responsibility for the App or its content. To the maximum extent permitted by law, Apple provides no warranty and has no obligation to provide support for the App. All claims must be directed to us, not Apple. In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. Apple is a third-party beneficiary of this agreement with the right to enforce it against you.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>13. Governing Law<\/strong><\/h3>\n\n\n\n<p>These Terms shall be governed by the laws of the State of Washington, without regard to its conflict of law provisions. You irrevocably agree to submit to the exclusive jurisdiction of the courts located in<strong> <\/strong>King County, Washington.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>14.
